It must include the name, address, and phone number of the person or company with full authority to negotiate, amend, and modify all terms of your loan. Call that contact. The law does not force them to change your loan, but it tells you who can. The notice counts as given on the day it is postmarked, even if you never pick it up. Check your mail and don't refuse certified letters.

When and where are foreclosure sales held?

Georgia foreclosure sales happen on the first Tuesday of every month, between 10 a.m. and 4 p.m., at the courthouse of the county where the home is (or another public spot the county has set by court order). If you send a complete application before then, it cannot start until it decides your application. If foreclosure has already started, a complete application received more than 37 days before the sale generally means the servicer cannot hold the sale until it has sent you a decision, any appeal is over, or you turn down or fail an offer. Applications that are only partly complete do not get this protection, so ask the servicer in writing what is missing. These rules cover most servicers of first mortgages on the home you live in. Small servicers follow fewer of them. If a servicer sells your home while a complete application is pending, talk to an attorney right away.

What counts as a "complete" application?

That list differs by servicer and loan type, but it usually includes a hardship letter, recent pay stubs or proof of income, bank statements, tax returns, and a signed form. Send the missing items fast, and keep proof of what you sent and when.

Sometimes, but your choices get fewer. Filing a bankruptcy case before the auction starts stops the sale right away. Your servicer can also agree to postpone. If you have the funds, the lender may accept a full payoff, or sometimes a late reinstatement, but many standard Georgia security deeds end your right to reinstate 5 days before the sale. Call the servicer and the foreclosure attorney named in your notice, ask for a postponement, and get any yes in writing with the new date. If bankruptcy is on the table, call a bankruptcy attorney the same day.

How does bankruptcy stop a foreclosure?

When you file for bankruptcy, a court order called the "automatic stay" goes into effect right away. It stops most collection actions, including a foreclosure sale. Can I sell my house if it is already scheduled for foreclosure?

Yes. You own the home until the auction. If you sell and close before the sale date, the loan is paid off at closing and you keep any equity left over. The key word is close. A signed contract alone does not stop the sale. Ask your servicer for a payoff quote and, if closing is near, ask it to postpone the sale.

I have equity. Why would I sell instead of letting it go to auction?

Because a foreclosure auction can wipe out much of your equity. The winning bid at auction is often far below what the home would sell for, and fees and costs come off the top first. Selling before the sale, whether with an agent or to a cash buyer, puts you in control of the price and the move-out date, and any money left after the loan is paid goes to you at closing.

How do I know if a cash buyer is legitimate?

Get at least two or three written offers and compare them to what a local agent says the home would sell for. Be cautious of "finders" who offer to recover the money for a large cut.
